These Terms and Conditions apply to your use of sarkfabrics.com and to all quotations, orders and supplies by Sark Fabrics Pvt. Ltd. (“Sark Fabrics”). By using this website or placing an order, you agree to these terms.
1. Website Use
Content on this website, including text, images and logos, belongs to Sark Fabrics and may not be copied or used without written permission. Product details and images are for general reference; actual shade, texture and finish may vary slightly.
2. Quotations and Orders
- Quotations are valid for the period stated on them, or 7 days if not stated, because yarn and raw material prices change.
- An order is confirmed only after written confirmation (purchase order, email or WhatsApp) and receipt of any agreed advance.
- Minimum order quantities (MOQ) apply and will be shared with the quotation.
- Specifications such as fabric type, composition, GSM, width, shade and finish must be approved by the buyer before production.
3. Prices and Payment
- Prices are in Indian Rupees and exclude GST, freight and insurance unless stated otherwise.
- Payment terms are as agreed in the quotation or invoice. Goods may be held until payment is received.
- Delayed payments may attract interest as permitted by law, including the MSMED Act where applicable.
4. Tolerances
Textile production involves natural variation. Normal industry tolerances apply to GSM, width, shade, shrinkage and quantity (typically up to ±5% unless agreed otherwise in writing). Variations within these limits are not considered defects.
5. Delivery
Delivery dates are estimates and depend on order size, yarn availability and approvals. We are not liable for delays caused by transporters or by events beyond our control, such as natural disasters, strikes, power failures or government action. Risk in the goods passes to the buyer on handover to the transporter unless agreed otherwise.
6. Job Work and Buyer-Supplied Material
For knitting job work, printing and cut-to-pack orders, the buyer is responsible for the quality of any yarn, fabric or designs they supply, and confirms they hold the rights to any artwork, logos or brand names provided for printing or labelling.
7. Returns
Returns, replacements and refunds are governed by our Refund & Return Policy.
8. Limitation of Liability
Our total liability for any order is limited to the invoice value of the goods concerned. We are not liable for indirect losses such as loss of profit or business.
9. Governing Law
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at Ludhiana, Punjab.
